Unity Litt — Guest Release and Waiver
In order to participate in a Unity Litt, LLC Experience, Unity Litt, LLC (your "Host") requires you to accept this Guest Release and Waiver, which is effective between You and Host as of the date when you first book or participate in an Experience as a "Guest", whichever happens first.
You represent that you are 18 years of age or older. If you are bringing a minor as a Guest, you acknowledge and agree that you are solely responsible for the supervision of that minor throughout the duration of the Experience and that you have read this Guest Release and Waiver and agree to it on the minor's behalf.
ASSUMPTION OF RISK
You understand and acknowledge that the Experience you sign up for may be hazardous and may carry the risk of injury or illness, including sickness, physical injury, property damage, disability, permanent paralysis, or death.
To the maximum extent permitted under applicable law, you knowingly, voluntarily and freely assume all risks, both known and unknown, of participating in the Experience, even if those risks arise from the negligence or carelessness of the Host, the Property, the Property Owners, or others, as well as if those risks arise from defects in the equipment, property, or facilities used during the Experience, or otherwise, and you assume full responsibility for participation in the Experience.
RELEASE AND WAIVER
You acknowledge and agree that:
- You have reasonably assessed the risks involved in the Experience and have made an informed and voluntary choice to participate.
- You alone, and not your Host, are responsible for determining your fitness for participating in the Experience and your ability to fully understand any directions or warnings presented.
- You promise not to participate in any Experience when you have a physical, medical, or mental limitation or disability, or when you are aware or should reasonably be aware of any factors that may limit or prevent you from safely participating in that Experience.
- You will act reasonably and responsibly and will comply with any provided and customary conditions, directions, and/or precautions for participation in the Experience. You agree to obey all federal, state, and local laws and to behave in a manner that does not cause harm to yourself or others. This includes, but is not limited to:
- You will not use illicit drugs.
- You will not touch another individual inappropriately or make another feel unsafe or uncomfortable. Even handshakes and hugs must be consensual.
- You will clean up after yourself.
- You will not take or move that which is not yours.
- You will not cause any property damage.
- You will obey all house rules provided to you, as well as those posted on the Host's website and any website associated with the Property.
- You will respect the laws of Torah within common spaces.
- You acknowledge that part of the experience will be in nature and there will be numerous elements from which the Host cannot protect you. This includes but is not limited to: uneven terrain; holes in the ground; falling branches and trees; poisonous plants; wild animals; insects that may be carrying diseases; water; and changes in weather.
- You acknowledge there are risks associated with using certain items on the Property, including but not limited to: heaters, fans, sauna, hot tub, pool, and kitchen equipment.
- You authorize the Host, the Property Owner, their partners and affiliates to take photos and videos of you and to use your name, voice, and likeness for both commercial and non-commercial purposes, with no time limit or geographic limitations.
INDEMNIFICATION
To the maximum extent permitted by law, you release and promise not to sue your Host, the Property, or the Property Owner for any claims, demands, causes of action, losses, damages, expenses, costs or liability of any nature whatsoever arising from or in connection with your Experience(s) and/or trip, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory.
You understand that if you do not comply with any of the rules listed above, you may be asked to leave. If asked to leave, you will be responsible for your own transportation costs and you will not be provided a refund. Additionally, you will be billed for any damage you cause.
You affirm that you have read this Guest Release and Waiver and fully understand the assumption of risk, release, waiver, and consent contained in it. You further understand that you have given up rights by agreeing to these terms and have done so freely and voluntarily and without inducement.
